These general terms and conditions of sale (the "General Conditions") apply exclusively to the sale of products marketed by the Seller on the Site (the "Products") to any natural or legal person wishing to make a purchase via the website www.solnare.fr, hereinafter referred to as the "customer".

PURPOSE

The acquisition of an item via the website www.solnare.fr implies unreserved acceptance by the buyer of these terms and conditions of sale.
These terms and conditions of sale shall prevail over any other general or special terms and conditions not expressly approved by the seller.

The seller reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

CHARACTERISTICS OF THE PRODUCTS OFFERED

The products offered are listed on the website www.solnare.fr. Each product is accompanied by a description and photographs, and in some cases, videos. The photographs and videos are chosen to be as faithful as possible but cannot guarantee a perfect similarity with the product offered, particularly concerning colors. Furthermore, as all jewelry is handcrafted by indigenous communities in Colombia and artisan jewelers, each piece is unique and may vary slightly from the photographs.

GEOGRAPHICAL AREAS

The online sale of items presented on the site is reserved for buyers residing in metropolitan France.

PRICES:

Prices are indicated in euros, including all taxes. The applicable VAT rate is the rate in force on the day of the order.

Solnaré reserves the right to pass on any change in the applicable VAT rate to the customer.

The seller reserves the right to modify its prices at any time. However, it undertakes to invoice goods ordered at the price indicated when the order was placed.

The indicated prices do not include order processing, transport, and shipping costs.

ORDERS:

The customer places an order on the website "www.solnare.fr".
To purchase one or more items, they must follow the following order process:

– Selection of items and addition to cart

– Validation of cart content

– Registration on the identification form where all requested contact details will be provided

– Choice of payment method.

- The customer will receive an order confirmation email.

At any time during the ordering process, the customer can view the details of their order, its total price, and correct any errors before confirming it to express their acceptance.

Solnaré retains ownership of the items until full payment of the order, i.e., until Solnaré has received the full price of the order.

Solnaré reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning the payment of a previous order.

Any order implies acceptance of the prices and descriptions of the items available for sale.

Solnaré undertakes to fulfill orders received on the website only within the limits of available stock.

PAYMENT

Payments are made online by credit card and are fully secured through the PayPal, CB, Shop Pay, or Apple Pay platforms.

You are not required to create a Paypal account to make your payment, but you can, of course, choose to use it if you have one.

SHIPPING AND DELIVERY TIMES

The Seller commits to offering free shipping for any order valued at 70€ or more.

Any order placed on www.solnare.fr will be prepared and shipped within one to three working days following payment validation.

Orders for metropolitan France will be sent via Colissimo with a tracking number.

www.solnare.fr undertakes to deliver orders to the address indicated by the Customer during the order process.

The estimated delivery time is three to ten working days after payment validation.

Any reasonable delay in the delivery of products shall not give rise to the allocation of damages or the cancellation of the order in favor of the buyer.

In case of a delivery error due to incorrect information provided by the Customer (incorrect delivery address, inaccessible location, or any other issue), requiring a new delivery, additional costs will be borne by the Customer.

Risks are transferred to the buyer as soon as the products leave Solnaré's premises. In case of damage during transport, a reasoned complaint must be addressed to the carrier within three working days from delivery.

Delivery times are indicative. If delivery is not made within thirty days from the order date, the sales contract may be terminated and the buyer reimbursed.

RETURNS

Right of withdrawal

In accordance with article L221-18 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal, without having to give any reasons or pay any penalties. However, return shipping costs remain your responsibility.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in the following cases:

• Alteration or modification of the Products
• Abnormal or non-conforming use or utilization of the Products
• Defects and consequences related to use inconsistent with the purpose for which the Products are intended
• Defects and consequences related to any external cause
• Normal wear and tear of the Products
• Failure to follow the return procedure by the Customer.

Products must be returned in their original and complete condition (packaging, accessories, etc.). Any product that is incomplete, damaged, or whose original packaging has been deteriorated will not be refunded or exchanged.

Return procedure

Before any return, you must make a request to Solnaré at the e-mail address hello@solnare.fr, providing the following information:

• Name and surname
• Phone number
• Order number
• Reason for return (withdrawal; refund or exchange, defective or non-compliant product)

Once your request is accepted, you may return your items, at your expense and with tracking, well-protected in their original packaging, to the address that will be provided to you.

RESPONSIBILITIES AND FORCE MAJEURE

The seller shall not be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure.

Within the meaning of these General Terms and Conditions of Sale, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1218 of the Civil Code.

INTELLECTUAL PROPERTY

All elements of the website www.solnare.fr, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents. They are and remain the exclusive intellectual property of the seller.

Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the seller, is strictly prohibited. The fact that the seller does not initiate proceedings upon becoming aware of these unauthorized uses does not imply acceptance of said uses or a waiver of prosecution.
